Terms of Service & End User License Agreement

1. Eligibility and Parental Consent

• Age Requirement: You must be at least 13 years of age to use the App. The App is not intended for children under 13.
• Minors (13-17): If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you represent that you have obtained the consent of your parent or legal guardian to use the App and agree to these Terms.
• Parental Responsibility: If you are a parent or legal guardian permitting a minor to use the App, you agree to be bound by these Terms on behalf of such minor and understand that you are responsible for monitoring their usage.

2. Acknowledgement

You and the Developer acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and the content thereof.

3. Medical Disclaimer (READ CAREFULLY)

NOBLEMAN IS A SELF-HELP AND PRODUCTIVITY TOOL. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

• NO PROFESSIONAL ADVICE: THE CONTENT, STRATEGIES, AND TOOLS PROVIDED IN THE APP ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THEY ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, PSYCHIATRIC THERAPY, OR ADDICTION TREATMENT.
• NO DOCTOR-PATIENT RELATIONSHIP: USE OF THIS APP DOES NOT ESTABLISH A DOCTOR-PATIENT OR THERAPIST-CLIENT RELATIONSHIP.
• RISK OF RELAPSE: RECOVERY IS A COMPLEX PROCESS. WE DO NOT GUARANTEE THAT USING THIS APP WILL PREVENT RELAPSE OR CURE ADDICTION.
• EMERGENCY: IF YOU ARE IN CRISIS, EXPERIENCING A MEDICAL EMERGENCY, OR HAVE THOUGHTS OF SELF-HARM, PLEASE CONTACT A MEDICAL PROFESSIONAL OR EMERGENCY SERVICES IMMEDIATELY.

4. Scope of License

The Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

5. Third-Party Services & Community (Discord)

The App contains links to a third-party community hosted on Discord.

• Third-Party Control: We do not own, control, or monitor the Discord platform. We are not responsible for the content, messages, or interactions that occur within the Discord community.
• User Responsibility: Any interaction you have with other users on Discord is solely at your own risk. You agree that the Developer is not liable for any harm, harassment, or offensive content you may encounter on third-party platforms.
• Separate Terms: Your use of Discord is governed by Discord’s own Terms of Service and Privacy Policy, not this Agreement.

6. Subscriptions and Billing

• Auto-Renewal: Subscriptions purchased via the App Store will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Management: You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
• Refunds: All refund requests must be handled directly through Apple Support. The Developer does not have the ability to process refunds for App Store transactions.

7. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

8. Warranty and Product Claims

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims of the End User or any third party relating to the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

9. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of the Developer. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; OR (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP OR LINKED COMMUNITIES.

12. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).

13. Third Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
